CORAM : N.W. SAMBRE, J.
DATE : 21st JANUARY, 2016 ORAL ORDER :
The applicant is seeking pre-arrest bail in Crime No.272 of 2015 registered with Dhule Taluka Police Station, Dist. Dhule for the offence punishable under Sections 306, 498A, 323, 504, 506 read with Section 34 of Indian Penal Code.
2.
The prosecution story in brief is that complainant's sister Anita, who was married to one Yogendra, has committed suicide and pursuant to the complaint lodged by complainant dated 04/11/2015, offence came to be registered against present applicants.
-23.
Learned Counsel for the applicants would urge that the applicants are falsely implicated in the crime in question. He would then urge that applicant No.1 Ramdas is 70 years and applicant No. 2 Shakuntalabai is of 68 years.
4.
Perused the F.I.R. and investigation papers. Though it is stated that there was complaint earlier lodged with Women Grievance Cell of Police Station about illtreatment, however, the Investigating Officer has confirmed that there was no such complaint lodged with Women Grievance Cell. Apart from above, it is required to be noted that from the investigation papers, it could be hardly inferred that custodial interrogation of the applicant is necessary. 5.
In view thereof, in my opinion, it will be appropriate to order the release of the applicants on pre-arrest bail. Hence, the following order.
In the event of arrest, the applicants be released on bail, in connection with Crime No.272 of 2015 registered with Dhule Taluka Police Station, Dist. Dhule for the offence punishable under Sections 306, 498A, 323, 504, 506 read with Section 34 of Indian Penal Code, upon executing P.R. bond of Rs.15,000/- with one surety
-3in the like amount, by each of them. The applicants shall attend the concerned police station on 27/01/2016 and 28/01/2016 in between 10-00 a.m. to 12-00 noon and thereafter as and when called by the Investigating Officer.
6.
The application is allowed in above terms.
