It is submitted by the learned Advocate for the Applicants that, wrongly the Appeal was preferred before the same Court i.e. the Sessions Court and when it was realized, the said Appeal was withdrawn and preferred this Appeal with the Application for condonation of delay. 4.

After hearing both sides and for the reasons mentioned in the Application, the aforesaid delay is condoned and the Application is allowed in terms of prayer clause 'B'.
