The learned A.G.P. informs us on instructions that, the hearing in the proceedings between the parties, pursuant to our earlier order dated 20/10/2023, passed in Writ Petition No.13133/2023, is scheduled on 07/11/2023 at 12.00 p.m. The notice indicates that the pleadings should be completed prior to 07/11/2022, so that the parties could be heard on the scheduled date.

In view of the above, we record that the legal representatives of the litigating parties would be at liberty to

13902.23wp (2) appear before Respondent No.1 on the said scheduled date and address the Authority. Written notes of submissions are also permitted. Compilation of case law may be appended to the written notes of submissions.

Needless to state, the impugned Section 40(e) communication, dated 25/10/2023, would be subject to the result of the interim application to be considered and decided by Respondent No.1. Any party aggrieved by the said order, would be at liberty to avail of the remedies, as are permissible in law. 4.

The Writ Petition stands disposed off.
