At the outset, learned Senior Advocate Mr.Hon seeks leave to withdraw the petition as regards prayer clause (B) and is pressing this petition only for prayer clause (C).

Looking to the fact that the petitioner is a lady above 80 years of age, it would be difficult for her to attend the proceedings before the Court of learned JMFC at Aurangabad, as presently she is residing at Dehradun in Uttarakhand. This Court, is therefore, considering the prayer only by way of sympathy that she need not appear before the Court on each and every date. She is already represented by one nominee of the company and an Advocate.

In view of the above, the petition is allowed in terms of prayer clause (C). Needless to say that this exemption will continue pending the prosecution.
