IN THE HIGH COURT OF JUDICATURE OF BOMBAY

Mr.M.S.Kulkarni, Advocate for respondent No.5. Mr.M.S.Deshmukh, Advocate for respondent No.4. ( CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.) DATE : JANUARY 20, 2023 PER COURT :

1.

The learned Advocate for the petitioner / applicant has prayed that paragraph Nos. 4 to 27 of the application be permitted to be added below paragraph No.3, in the writ petition. He submits that the paragraph numbers would be re-arranged after paragraph No.3. 2.

The learned Advocates for the respondents have opposed on the ground that the magnitude of the amendment itself is enough to dispose off this petition with liberty to the petitioner to file a fresh khs/Jan.2023/16999

- 2 - petition.

3.

The learned Advocate for the petitioner / applicant submits that it is cumbersome for the applicant to file a fresh petition in view of the fact that the petition would then be registered as a 2023 petition. He can conveniently carry out the amendment and tender a freshly typed amended copy of the memo of the petition.

4.

In view of the above, this application is allowed. Addition/ amendment be carried out on or before 04.02.2023. The respondents in the petition are at liberty to file their affidavits in reply / additional affidavits in the light of the amendment, within 2 weeks thereafter. 5.

List the writ petition on 03.03.2023.
