Heard.

These writ petitions are questioning the order rejecting applications for condonation of delay filed in the petitions preferred before the Lower Appellate Court. In the wake of latest decision rendered in the matter of Devidas Ganpati Kale vs Munirbi Mahebub Karanje, The writ petitions are not maintainable against rejection of application for condonation of delay passed in the proposed appeal by the Lower Appellate Court.

The learned Counsel for the petitioners seeks permission to withdraw the writ petitions with liberty to prefer the proceeding as permissible in law. He further prays that he may be exempted from filing Vakalatnama which have been filed in the present petitions. 3.

The writ petitions are disposed of as withdrawn with liberty as prayed for.

It is clarified that the learned Counsel for the petitioners are exempted from filing separate Vakalatnama but notes of appearance can be filed.
