Heard learned Counsel for the respective parties. 2.

Learned Counsel for the petitioner submits that during the pendency of present petition, the petitioner has expired. As the proceedings are instituted under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, and the petitioner is reported to be dead, the present proceedings cannot be proceeded with further. He further submits that Civil Application No. 12919/2025 has been filed by the daughter of the deceased petitioner for substituting her as petitioner. 3.

Considering the submissions advanced, the said application cannot

However, it is made clear that if the applicant in the Civil Application is desirous of initiating proceedings to assert her claim in respect of the property, she is at liberty to initiate appropriate proceedings before the competent Court in accordance with law. 5.

The competent Court shall decide such proceedings without being influenced by the order passed by this Court. 6.

In view thereof, the Writ Petition along with pending Civil Application stands disposed of.
