PER COURT :- 1.

In response to the order passed by this Court on 16.9.2015, in Civil Application No.9102/2015 the appellant/insurer has deposited the entire amount under the Award before this Court.

The applicant no.1 is widow and applicant nos. 2 to 4 are the minor children and applicant nos. 5 and 6 are the aged parents.

3.

The appellant insurer has raised certain defences. However, considering the nature of the defence, the applicants in this civil application can be permitted to withdraw 50% amount awarded by the Tribunal. Hence, order.

ORDER

1.

Civil Application is partly allowed.

2.

The applicants are hereby permitted to withdraw an amount of Rs.8,50,000/- (Rs. Eight lacs Fifty Thousand only) alongwith accrued interest, in equal shares.

3.

Civil Application accordingly disposed of.
