Deewakar Vishwanathrao Urne v. The State Of Maharashtra And Others
CP No. 82/17
IN THE HIGH COURT AT BOMBAY
APPELLATE SIDE, BENCH AT AURANGABAD 904 CONT. PETITION NO. 82 OF 2017 IN CP/401/2014 DEEWAKAR VISHWANATHRAO URNE
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Mr. A.V. Patil-Indrale Advocate for Respondents : Mr. A.S. Bajaj ...
CORAM : T.V. NALAWADE AND SANGITRAO S. PATIL, JJ.
DATED : February 24, 2017.
ORDER :
The petition is filed as petitioner feels that directions given in Writ Petition No. 917/2014 by this Court on 26.3.2014 are not complied with by the respondents.
2.
The petitioner, who is employee of respondents had given representation to respondent No. 2 and he had made allegations against some superior officers. He had contended that action was taken only against him, but the superior officers were spared by the respondents. In view of this contention, direction was given to take
CP No. 82/17 decision on the representation within two months from 26.3.2014.
3.
It appears that departmental enquiry was held against the petitioner also and he was held guilty up to the appellate stage in the said departmental enquiry. Reply filed for the respondents shows that they made enquiry against those superior officers and have found substance and due to that, they have already started departmental enquiry against those superior officers viz. Deputy Engineer and Superintendent Engineer. Copy of chargesheet is produced along with the reply. Due to this contention and the record, this Court holds that substantial compliance of the aforesaid order made by this Court has been done. There is no need for continuation of present proceeding. The petition is dismissed.
