Applicant seeks to condone the delay of 2599 days caused in filing appeal against the award passed by the Reference Court.

Perused the application and reasons stated therein. Applicant is agriculturist and lost his land due to compulsory acquisition. He filed reference under Section 18, which came to be dismissed. The applicant could not approach this Court

156-ca-360-2025 within time due to financial duress. The contents of application are not disputed. Looking to the nature of the dispute and reasons stated in the application, case is made out to condone the delay, subject to certain condition. Hence, following order:

ORDER

i.

Civil Application is allowed.

ii.

Delay of 2599 days caused in filing appeal is condoned, subject to condition that applicant files an undertaking to Registrar (Judicial) of this Court within a period of eight weeks from today stating that he shall not claim interest and statutory benefit for the period of delay.

iii.

Civil Application is disposed of.
