When this court expressed its disinclination for allowing the application, learned advocate for applicant, on instructions, seeks leave to withdraw the application. Leave is allowed.

Learned advocate for applicant submits that trial be expedited.

Considering all the facts and circumstances of the case, if the Special Court is not directed by any court for expeditious hearing of any other trial, this trial may be conducted as expeditiously as possible by keeping in mind that it is a special case as well as covering sections of IPC etc. The trial court shall try the case as if it is sessions trial. Needless to mention that sessions means once sessions case is started, it shall not be stopped.

Learned trial court /special court shall consider above order, if accused is cooperating for hearing. 6.

Fees of learned advocate for respondent No.2 shall be paid by High Court Legal Services Sub-Committee, Aurangabad as per rules.
