Applicants seeks condonation of delay caused in preferring application for setting aside abatement and bringing legal heirs of applicant No. 2 - Sadanand Bhagwat Yelgatte on record. 2.

The cause of action survives against the legal heirs as shown in para No. 5 of the application. There are no malafides on the part of the applicants in preferring the application belatedly.

The civil application is allowed in terms of prayer clauses 'A' and 'B'. The civil application is disposed of. 4.

Amendment shall be carried out within a period of two (02) weeks from today.
