Present application is for grant of regular bail on account of arrest of applicant in Crime No.0302 of 2017 registered at Cantonment Chawani Police Station, Aurangabad for the offence punishable under sections 302, 201, 120-B r/w section 34 of Indian Penal Code.

While arguments for bail were in progress, learned APP pointed out that, trial is underway and moreover it is conducted almost on day to day basis. Learned counsel for applicant also agrees with the above situation and he seeks permission to

-2- BA.2227.2024 withdraw the instant application. However, he expresses apprehension that trial may not get concluded early and moreover applicant is behind bars since March 2018. Consequently, he prays that, if trial is not over within six months or so, he be given liberty to approach afresh for bail.

In view of above, application is disposed off as withdrawn with liberty to the applicant to apply for bail if trial is not concluded by December 2025.
