Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant has been arraigned as an accused in the case of suicide of a college girl. The prosecution has evidence of conversation between the deceased and the accused, 2 months before the alleged incident. The applicant has a case that he had affair with the deceased but there were some differences between them. Hence, he stopped talking to her. Therefore, she might have been disappointed. The applicant never abetted her to commit suicide. There appears no proximity in committing the crime and the alleged abetment. Two months after the last conversation, she has committed
957-BA.2118-22.odt suicide. The prosecution has no evidence of any contact with her after last conversation. The material investigation has been completed. The applicant is a young boy. No purpose would serve, if the applicant is kept behind bar. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant VIJAY MOHAN SARDAR be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.791 of 2022, registered by Police Station MIDC, District Ahmednagar, for the offence punishable under Sections 306, 504 of the IPC, on the conditions not to contact any of the witnesses and co-operate with the Investigating Officer, if called on written notice till filing of the charge sheet.
