The petitioner is objecting to the decision dated 22.11.2016, passed by the learned Member, Maharashtra Administrative Tribunal, Aurangabad, setting aside the appointment order issued in favour of petitioner, appointing her as a Police Patil.
One of the conditions incorporated in the advertisement, for being eligible to participate in the process of selection, was that the candidate, desirous of securing employment, shall not hold the office of Member of Village Panchayat and shall not be in employment in a private or semiGovernment establishment. The petitioner was holding the post of Member of Village Panchayat at the time of continuation of process of selection. In view of violation of Condition No.6 incorporated in the
{2} wp1223816.odt advertisement, petitioner is ineligible to participate in the process of selection and as such, the Maharashtra Administrative Tribunal was justified in setting aside the appointment order issued in favour of the petitioner. Apart from this, it is revealed that petitioner was holding the post of "Prerika" under Lokshikshan Centre, Sanglewadi.
We have perused the order passed by the Maharashtra Administrative Tribunal in Original Application No.352 of 2016. We do not find any infirmity in the impugned order and the reasons recorded by the Maharashtra Administrative Tribunal are reasonable and proper.
In exercise of extraordinary jurisdiction of this Court under Article 226 of the Constitution, no interference is called for. Petition is devoid of merit.
Writ Petition stands dismissed.
