1] The First Appeals are filed by the Insurance Company against grant of compensation on the ground of non involvement of the insured vehicle in the accident. 2] The present Civil Applications are filed for withdrawal of the amount deposited by the Insurance Company in this Court. Arising out of the same accident, by order dated 02.01.2023 in Civil Application No.17289 of 2022 in First Appeal No.583 of 2022, this Court has permitted the other applicants to withdraw 50% amount deposited along with interest accrued thereon till date by furnishing usual undertaking to the satisfaction of the Registrar [Judicial] of this Court.
3] In view of the same, the applicants are permitted to withdraw 50% amount deposited along with interest accrued thereon till the date by furnishing usual undertaking to the satisfaction of the Registrar [Judicial] of this Court. The remaining amount be invested in F.D.R. in any Nationalized Bank on yearly renewal basis till disposal of the First Appeals.
3] All Civil Applications are accordingly disposed of.
