Applicants apprehend arrest in Crime No.184/2022, registered with Bhada Police Station, Latur, for offence punishable under Sections 498(A), 304(B), 306, 323, 504 r/w 34 of the Indian Penal Code.

FIR is lodged by mother of deceased Vaishnavi alleging that Vaishnavi's marriage with Prajyot, son of applicant No.1 and brother of applicant No.2, was solemnized on 21/04/2022. Vaishnavi was residing in joint family of in-laws. For one month Vaishnavi was treated well and thereafter the in-laws started harassing her on account of bringing Rs.5 Lakhs from her parents house to purchase a harvester. Physical and mental harassment was caused to Vaishnavi. Vaishnavi was seven months pregnant when she committed suicide on 21/11/2022 by hanging herself. SVH

Heard learned advocate for applicants and learned Additional Public Prosecutor for respondents - State. Perused the investigation papers.

Husband of deceased Vaishnavi is arrested. There are vague and general allegations levelled against applicants. Except statements of parents, there are no other statements like statements of neighbours, corroborating allegations of mental and physical harassment of deceased. Considering the general allegations levelled against applicants and since nothing is to be recovered from them, so also, applicant No.1 being a woman and since applicant No.2 is taking education, their pre-trial custodial detention is not necessary in the facts of the present case. 5.
Application is, therefore, allowed by confirming the interim order dated 21/12/2022. Till filing of charge-sheet, applicants shall attend concerned police station as and when called by investigating officer. Appellants shall not tamper prosecution evidence.
