Mr.Bhavthankar and Mr.Salunke, learned counsel for the Respondents raise a preliminary objection that the petitioner has an alternate remedy to file appeal before the Divisional Commissioner, under Rule 14 of the Maharashtra Zilla Parishads and Panchayat Samitis Rules.

In light of that, though learned counsel for the petitioner sought to canvass the submissions on merits, we are not inclined to consider the same.

The Writ Petition as such is disposed of with liberty to the

petitioner to avail the alternate remedy.

All contentions of the respective parties are kept open. 6.

The authority where the proceedings would be filed, shall consider the time spent in prosecuting the present litigation. No costs.
