IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.12172 OF 2016 Sneha Sunil Tanpathak & others Petitioners
Versus
State of Maharashtra & others Respondents Mr.S.G.Chapalgaonkar, advocate for petitioners. Mr.K.D.Mundhe, A.G.P. for Respondents No.1 to 4. CORAM : R.M.BORDE & SANGITRAO S. PATIL, JJ.
DATE : 07th December, 2016 PER COURT:
The substantive petition presented by Respondent No.4-Institution i.e. Pravara Medical Trust's Ayurvedic College at Shevgaon, being Writ Petition No.11893 of 2016, has been permitted to be withdrawn and disposed of as such, on the request of the said petitioner. Petitioners-students, in the instant petition, are raising substantially same grievance, as has been raised by the Institution. Petitioners are seeking a direction for protection of their admission or for accommodating them in the available vacancies.
It would not be permissible to issue such direction since the State Government has decided to adopt Centralised Admission Process. The State Government has intervened in the matter and directed cancellation of process of admission on noticing certain illegalities adopted during the process of admission. The State Government has acted in pursuance to the
{2} wp1217216.odt report of the Regulatory Authority as well as on the basis of complaints received concerning the process of admission. The petitioners, who have secured admission, can be said to be party to such illegalities and as such, no relief can be claimed by them in the instant petition. It would, however, be open for the petitioners to appear in the next/further rounds of process of admission. In view of above, writ petition stands disposed of. (SANGITRAO S.
