The learned A.G.P. appears for respondent nos. 2 and 3. None appears for respondent no. 1, who is the claimant and the contesting party. 3.

The applicant-acquiring body is seeking condonation of delay of 851 days in preferring the appeal. There is nothing on record to controvert the averments of the applicant. I do not find any mala fides on the part of the applicant. It transpires from record that the applicant has already deposited the amount with interest.
