Learned advocate for the petitioner submits that presently, he is only keen to get the relief claimed in prayer clause (B) whereby he has solicited a direction to the Tahsildar, Aurangabad for issuance of Eligibility certificate for economically weaker section. It is being pointed out, for the year 2022-2023, the respondent no. 3 - Tahsildar had issued a similar certificate, but in the current year, he is not considering or deciding petitioner's application. He is being orally told that he is not eligible to get it.

Since the petitioner's application is pending with the respondent no. 3 seeking the afore-mentioned certificate, either the respondent no. 3 shall issue the certificate or pass suitable order if he has reasons to refuse.

We dispose of the writ petition by directing the respondent no. 3 to consider the petitioner's application and either to issue the certificate to him as prayed for or shall pass a suitable order assigning reasons. The decision shall be taken as expeditiously as possible and in any case within four weeks.
