The learned Counsel for the applicants submitted that, First Appeal No.3056 of 2008 which was initially filed before this Court was transferred to the District Court after the pecuniary jurisdiction of the District Court was enhanced and the said appeal has been finally decided by the District Court. The learned Counsel has, however, not placed on record the copy of the judgment passed by the District Court. In the circumstances, though the request for permitting withdrawal of the amount deposited in the said matter in this Court cannot be considered, I deem it appropriate to transmit the said amount to the District Court, so that, the necessary applications can be filed by the claimants before the District Court and the District Court

2 14334.2017CA.doc may pass necessary orders verifying the facts whether the petition has been disposed of and whether the applicants are entitled to receive the said amount. Order accordingly. 2.

Registry to transmit the amount deposited in this Court to the District Court, Aurangabad.
