Heard the learned Counsel for the respective parties. By way of present petition, the petitioner assails the order dated 14.08.2023 passed below Exhibit 5 by the District Judge-4, Osmanabad in Regular Civil Appeal No. 39 of 2023, whereby, the application for stay of execution filed by the Petitioner came to be rejected.

Both the learned Counsel for the parties submit that the appeal is pending before the appellate Court and purpose would be served if this Court directs the appellate Court to decide the appeal within stipulated period.

Therefore, appellate Court is directed to decide the appeal

156wp14364.23 within a period of three months from today.

Interim relief granted by this Court on 10.11.2023 to continue till the decision of appeal.

This Court has continued the interim relief only on the ground that the same is in operation since 10.11.2023. The trial Court shall not be influenced by continuation of interim relief and shall decide the appeal on its own merits.

In view thereof, the Writ Petition is disposed of alongwith pending civil application if any.
