Advocate Mr. C.B. Thombare for appellant/acquiring body is present with Mr. S.N. Jewalikar, Executive Engineer, Lower Terna Canal Division No.2, Latur. Mr. G.O. Wattamwar, AGP for the State is present. Advocate Miss. Sujata Puri is also present for the respondent No.2. Statement is made that the entire amount is deposited by the acquiring body before this Court. The matter is covered by Government Resolution dated 03.11.2016 read with subsequent corrigendum dated 23.02.2017 and 13.08.2018. In view of the decision in State of Maharashtra vs. Kailash Shiva Rangari, 2016 (4) All M.R., 513 (F.B.) and State of Maharashtra vs. Ramesh Tukaram Meshram and another, 2018

(1) All M.R., 645, both parties agreed that the interest should be awarded

FA_303_2019 from the date of the Award of Special Land Acquisition Officer and accordingly the Award can be passed.

In view of the said fact that parties have arrived at above said compromise.

The First Appeal is disposed of as compromised. Court fees be refunded as per rules.

After calculating the interest in view of aforesaid pronouncement, excess amount, if any, be returned back to acquiring body. Rest of the amount be given to the claimant as per the impugned Award.
