The applicant is seeking condonation of delay of 589 days in filing second appeal. The learned counsel for respondent No.1 strongly opposed the application on the ground that the applicant was already aware about the impugned judgment well in advance, but he did not care to file the appeal within stipulated period. However, considering the statutory right of the applicant, the application stands allowed in terms of prayer clause-A and disposed of accordingly.
