The present first appeal is filed along with application for condonation of delay of 185 days caused in filing the first appeal. The learned Advocate for the respondent opposes the application. 2.

The learned Advocate for the applicant submits that due to the accidental death of Karta of the family and so also the applicant was constrained to lead her life by raising private loans and she was not aware of the legal proceedings. The applicant after receipt of certified copies of the relevant documents, approached the Advocate at High Court. Therefore, the delay is caused in preferring the appeal.

In view of the submissions made and for the reasons stated in the application, the application is allowed and disposed of. 4.

The appeal is Admitted.

After admission, the learned Advocate Mr. A.D . Wange waives service of notice on behalf of respondent.
