This is an Application for suspension of the substantive sentence.

Heard the learned Advocate for the Applicant and the learned APP for the State.

The Applicant/Appellant is convicted by the learned Additional Sessions Judge, Osmanabad, in Special Case (Atro) No. 5 of 2020, by the Judgment and Order dated 13.10.2025, for the offences punishable under Sections 323, 294 r/w 34 of the Indian Penal Code. For the offence punishable under Section 323 of the IPC, the Applicant/Appellant is sentenced to suffer simple imprisonment for

2 Prodn1APPLN4306.2025.odt three months with fine of Rs. 700/-, in default, to suffer simple imprisonment for two months, and for the offence punishable under Section 294 of the IPC, the Applicant/Appellant is sentenced to pay a fine of Rs. 800/-, in default, to undergo further simple imprisonment for 15 days.

The learned Trial Court has suspended the sentence till the Appeal period and has granted bail to the Applicant/Appellant. 5.

Considering that the sentence is term sentence, the order of suspension and bail granted by the learned Trial Court to continue during the pendency of the present Appeal.

The Application stands disposed off.
