By the present application under section 439 of the Code of Criminal Procedure, the applicant seeks his release on bail, in connection with C.R. No.343 of 2015, registered with Tophkhana police station, Dist. Ahmednagar, for offences punishable under sections 143, 147, 148, 149, 324, 323, 504, 506, 326 of the Indian Penal Code and under section 4/25 of the Arms Act.

Perusal of the first information report and other investigation papers depicts that no specific overt act is ascribed to the applicant, but for his presence at the time of commission of the offence. 3.

Custodial interrogation of the applicant is already over.

In view thereof, the applicant deserves to be released on bail. I, therefore, pass following order :- The applicant be released on bail, in connection with C.R. No.343 of 2015, registered with Tophkhana police station, Dist. Ahmednagar, for offences punishable under sections 143, 147, 148, 149, 324, 323, 504, 506, 326 of the Indian Penal Code and under section 4/25 of the Arms Act, on furnishing P.R.
