After arguing for sometime, the learned counsel for the Petitioner seeks leave to withdraw the petition. 2.

The learned counsel for the Petitioner submits that by the impugned order on account of failure on the part of the Petitioner to supply the layout, the Civil Judge, Senior Division has directed that the suit will be dismissed. He would therefore, urge that he may be permitted to pursue such other remedy by way of filing an appropriate application before the learned Civil Judge, Senior Division to demonstrate that without the sanctioned layout, DILR is able to execute commission.

Considering the prayer made and the fact that the impugned order directs the dismissal of the matter, liberty is granted to the Petitioner to adopt appropriate remedy including
