The learned Senior Counsel for the applicant, on instructions, seeks permission to withdraw the same. He further submits that the applicant intends to have medical aid from private hospital.

The request with regard to having medical aid from private hospital is opposed by the learned Additional Public Prosecutor and learned Counsel for the informant.

The application is permitted to be withdrawn. After the applicant surrenders in terms of the order of the Hon'ble Supreme Court, it would be open for the applicant to approach the Sessions Court with a prayer seeking appropriate medical aid from a private hospital. If such request is made, the same shall be considered on its own merits expeditiously and in accordance with law.
