VERSUS

Mr. Ajinkya Kale, i/b Talekar and Associates for the Petitioner Mr. S. Ganesh i/b Ms Smita S. Kulkarni, Advocate for Applicant Mr. P. S. Patil, APP for the Respondent - State ....
CORAM : SANDIPKUMAR C. MORE AND Y. G. KHOBRAGADE, JJ.
DATE : 17.11.2025 PER COURT :- 1.
Heard.
2.
Learned counsel for the petitioner submits that pursuant to the complaint dated 16.01.2024 and the order of this Court dated 15.10.2025, the F.I.R. is already registered with Shirdi Police Station bearing F.I.R. No.936 of 2025 on 17.10.2025.
(( 2 )) 65-Cri-WP-791-2024 3.
As such, the purpose of this petition is already served. 4.
Learned counsel for the petitioner, therefore, seeks permission to withdraw the Writ Petition. However, the learned counsel for the intervener Mr. Sahebrao Pandurang Lanke, who is also accused in the aforesaid F.I.R., submits that the co-ordinate Bench of this Court in Writ Petition No.7046 of 2025 under order dated 12.06.2025, had already directed that Sansthan should not take any coercive action against the intervener. His main grievance is that the learned counsel for the petitioner at the time of order dated 15.10.2025, did not bring it to the notice of this Court. As such, he prayed for recall of the order dated 15.10.2025, or, in the alternative, for its modification with a clarification to the effect that no coercive action be taken by the Investigating Officer. However, pursuant to order dated 15.10.2025, the offence against the intervener and other persons is already registered and therefore, no question of modification/ clarification or recalling of order dated 15.10.2025, now arises.
5.
Be that as it may, the purpose of this petition is already served and therefore, the present writ petition stands disposed of
(( 3 )) 65-Cri-WP-791-2024 along with intervention application filed by the intervener. The intervener may seek appropriate remedy for redressing his grievance, separately.
