AUGUST 01, 2025 ORDER :- Heard learned counsel for the petitioner and learned counsel for respondent no.2 - Municipal Corporation. 2.

The petitioner was in the service of respondent no. 2 - Municipal Corporation as an `Accounts Officer' and has retired in November, 2023. However, his pensionary benefits have not been released. According to learned counsel for the petitioner, the Chief Accounts Officer was having grudge against the petitioner and therefore, the pensionary benefits are withheld. He submits that direction may be given to respondent - Municipal Corporation, to decide the petitioner's claim in respect of the pensionary benefits.

Learned counsel for respondent no.2 - Corporation tenders across the bar a copy of the reply affidavit. The same is taken on record. He submits that there are discrepancies in the pension proposal of the petitioner and therefore, the pensionary benefits are not released. Learned counsel for respondent no.2 - Corporation disputes the allegations that it's Chief Accounts officer was having grudge against the petitioner.

After hearing both sides and considering that respondent no.2 has not taken any decision in respect of the pension claim of the petitioner, we direct respondent no.2 - Corporation to consider and take a decision in respect of the proposal of the petitioner's pension, on its own merits, within a period of two weeks from the date of receipt of a copy of this order. The petitioner shall appear before the respondent no.2 - Corporation on 05.08.2025. The petition stands disposed of accordingly.
