1] Heard learned counsel for the appellant. Perused the evidence of the prosecution witnesses and in particularly, PW-4 Annasaheb Patil and also medical evidence. PW-4 is an injured witness who has named the respondent Nos. 2 to 4 and also overt acts are attributed to them. Evidence of PW-4 gets support from the medical evidence. There is also other evidence on record which is not properly considered by the trial court. Therefore, case is established to allow the application seeking leave.
