Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant has approached this Court apprehending arrest in connection with Crime No.324/2024, registered with Aurad Shahjani Police Station, District Latur, for the offences punishable under Sections 132, 303(2), 352, 351(2), 351(3), 352, 3(5) of the B.N.S. & under Sections 48(7), 48(8) of MLR Code, 1966. 3.

In the instant case from the FIR the role of the applicant is seen. It is alleged that the applicant / accused no. 3 (mentioned in the FIR as unknown person) has forcibly taken away the tractor head of the trolley in which sand was illegally being transported, so also, the applicant abused and threatened that the applicant would not spare them

2 922 i.e. the informant and the police personnel on duty thereby, obstructed the public servants from executing their duties. 4.

The learned APP points out that there are 2 antecedents against the applicant i.e. another crime of similar nature qua the illegal sand transportation and the second is under Section 325 and other sections of the IPC .

Prima facie, considering the facts of the case and the antecedents of the applicant, the application is dismissed. [ARUN R. PEDNEKER, J.] marathe
