Heard the learned counsel for the applicant.

The learned counsel for respondent no.1 strongly opposed the application on the ground that, it is a pre-cognizance stage and the applicant does not have any right to participate in the proceedings.

It appears that, the application is filed purportedly under the provisions of Section 319 of the Code of Criminal Procedure and in that view of the matter, present applicant against whom the application came to be filed is necessary to be heard in this Criminal Writ Petition.

In view of the above, Criminal Application is allowed in terms of prayer clause 'A'.

5.

Criminal Application accordingly disposed of. 6.

Place the Criminal Writ petition No. 1494/2015 for hearing on 13.9.2016.
