The non applicants in the first civil application have been served. Respondent No.3 is reported to be dead. The writ petition was dismissed at the notice stage since the notice could not be issued in the writ petition on account of non supplying of the petition paper book.

A separate civil application No.4744/2018 has been filed for bringing the LR's of deceased respondent No.3 on record. 3.

Considering that the first civil application has been filed within limitation, the same is allowed subject to costs of Rs.2,000/- only to khs/JAN.2019/16291-d

- 2 - be deposited with the Government Medical College and Hospital, Aurangabad, through Medical Officer, High Court Dispensary, Aurangabad, either in cash or by Demand Draft (Demand Draft be drawn in the name of "Dean, Government Medical College and Hospital, Aurangabad Dengi Samiti") on or before 13/02/2019. If the costs is not deposited, the petition would stand dismissed without reference to the Court on 02/03/2019. 4.

Issue notice to respondent Nos.1, 2 and 4 in the writ petition and to the LR's only in CA No.4744/2018, returnable on 01/03/2019. Copies for issuance of notices in both the civil applications and the writ petition shall be tendered on or before 05/02/2019, failing which, all these civil applications as well as the writ petition would stand dismissed without reference to the Court on 06/02/2019.
