Learned Counsel for the petitioner submits that the validation proceeding is pending since year 2005. Vigilance is conducted. Say is also fled. The employer has issued show-cause notice to the petitioner to submit the validity certifcate or else action would be taken. 2.

Considering the fact that the validation proceeding is pending, we pass the following order.

(i) Scrutiny Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner on or before 15 January 2020.

(2) WP-14154.2019.odt (ii) The petitioner shall appear before the Committee on 5 December 2019.

(iii) The employer shall not take adverse action against the petitioner only on the ground that the validation proceeding is pending.

The employer may take further course of action depending upon the judgment of the Scrutiny Committee on the validation proceeding.

Writ Petition is disposed of. No costs.
