Applicants apprehend arrest in Crime No. 180/2023, registered with Itwara Police Station, Nanded, for offences punishable under sections 395, 435, 341, 324, 323, 504, 506, 427 of the Indian Penal Code.

FIR is lodged by Ashikhur Rehman Mohammad Badredoja alleging that he and his friend Mohd. Israil Shaikh were working at Hotel Akruti. On 18.06.2023, at about 4.30 pm,
{2} after doing his morning duty, he and his fried Mohd. Israil Shaikh proceeded to met their women colleagues. Then they proceeded in Auto rickshaw and motorcycle towards Hingoli gate for purchasing some articles. Thereafter, they returned back to old Mondha at about 6.40 pm. They chit chatted with women colleagues for some time and thereafter both women colleagues left in Auto rickshaw towards hotel Akruti. At that time, three unknown persons came to them and asked about women colleagues and started beating them. One of them called 7-8 persons there and all of them assaulted informant and his friend with sticks, kicks and fists blows. In the said incident Rs. 1500/- and his cell phone was snatched, so also Rs. 2500/- and Realme company cell phone of friend Mohd. Israil Shaikh was taken away. Their Motorcycle was set on fire.

Heard learned advocates for applicants, learned APP for respondents. Perused the investigation papers. 4.
In the present crime, four accused i.e. Vinit Choudhary, Sumitsingh Choudhary, Akshay Thakur and Pratik Shahu were arrested and they are released on bail. Name of present applicants were revealed by co-accused and they are named by informant in supplementary statement.

Both applicants claim to be students and have no criminal antecedents, if applicants are arrested their future will be marred. Considering the role attributed to applicants, nothing is to be recovered from them, their custodial interrogation therefore is not necessary in the facts of the present case. 6.
In the result, applications are allowed.

In the event of arrest of applicants- Sanket Sanjay Pardesi and Archit Manojsingh Choudhary, in connection with Crime No. 180/2023, registered with Itwara Police Station, Nanded, for offences punishable under sections 395, 435, 341, 324, 323, 504, 506, 427 of the Indian Penal Code, they be released on executing P.B. and S.B. of Rs. 15,000/- each with one surety in the like amount.

Applicants shall attend the concerned police station from 29th January, 2024 to 1st February, 2024, everyday, between 10.00 am to 12.00 noon and shall co-operate in the investigation. Applicants shall not tamper the prosecution evidence.
