Heard the learned counsel for the applicants/original claimants and the learned counsel appearing for respondent no.3/insurer. There is a delay of 43 days caused in fling the appeal against the judgment and award passed by the MACT, Aurangabad dated 2.7.2018 in MACP No.248 of 2013. The applicants/original claimants have preferred said MACP on account of the death of the bread earner of the family in the motor vehicular accident.

In view of the same and for the reasons stated in the application, civil application is allowed in terms of prayer clause 'B'. Civil application accordingly disposed off. 3.

In First appeal, issue notice to the respondents, returnable on 9.6.2022. Learned counsel Mr.Patil waives notice for respondent no.3. Call R & P.
