Learned A.G.P. submits that much time has been consumed in securing legal opinion and the approval from the concerned department for filing appeal, and as such, delay has been occurred in filing the appeal. Delay is not intentional one and applicant/State has been prevented from sufficient cause to prefer appeal within a period of limitation.

In view of the above submissions and for the reasons stated in the application, delay of 908 days caused in filing First Appeal is hereby condoned. Application is allowed accordingly and disposed of.
