The learned counsel Mr. Naresh Tambade holding for Mr. Thombre for the appellant as well as learned counsel Mr. R. N. Dhakane holding for Mr. Karad for respondent No. 6 submit that the original claimants, who are present respondent Nos. 1 to 5 have settled the matter amicably with the present applicant before the executing Court i.e. Motor Accident Claims Tribunal, Aurangabad in the execution proceeding bearing M.A.C.Dar. No. 9/2017 by accepting compensation of Rs. 7,00,000/-. The learned counsel for the present appellant also tendered across the bar copy of the said execution

proceeding along with the order of learned Tribunal thereon and also the compromise terms which are taken on record and marked as 'X' for identification. Since the contesting parties have already settled the matter, the present appeal stands withdrawn and disposed of. 2.

The pending Civil Application No.390/2007 also stands disposed of accordingly.
