Learned Counsel for the Petitioners, on instructions, submit that he does not wish to press any other relief in application Exh. 185 except for deletion of name of the guardian of plaintiff no. 1(1)

Learned Counsel for contesting Respondent records no objection for deleting the name of guardian of Aarsh Kamlesh Jaiswal.

Learned Counsel for the Petitioners, therefore, seeks withdrawal of the Petition with aforestated order.

In view of the above, impugned order passed below Exh. 185 in RCS No. 99/2001 is set aside to the extent of amendment for deleting name of the mother of the Aarsh as guardian.

Learned Counsel for the Petitioners makes statement that on the next date of hearing amendment shall be carried out.

It is clarified that after the amendment no further opportunity needs to be given to said Aarsh as he was duly represented by guardian till date and it is not case of Petitioners that interest of minor has not been protected by the guardian.

In view of the above, Writ Petition is disposed of.
