Heard Mr. Veer, learned advocate appearing for petitioner. 2.

The present petition takes exception to the order dated 11.08.2023 passed by the Sub Divisional Officer, Basmath. 3.

Learned AGP objects for entertaining present writ petition in view of alternate efficacious remedy to challenge the impugned order. Apposite to the aforesaid objection, learned advocate appearing for petitioner seeks permission to withdraw writ petition with liberty to file appeal/revision as permissible under law before the competent authority, however, request this Court to expedite hearing of such appeal and also consider the time consumed in prosecuting present writ petition, in case the objection as to delay is raised.

In view of aforesaid submissions, writ petition stands dismissed as withdrawn with liberty in favour of petitioner to file

924-wp15182-2023.odt (2) appeal before Additional Collector impugning the order dated 11.08.2023. In case the petitioner presents appeal within a period of three weeks from today, the time consumed in prosecuting present writ petition be taken into account for counting of limitation. Further, on presentation of appeal within aforesaid timeline, it shall be decided within a period of three months from the date of presentation of appeal.
