Heard learned counsel counsel for applicants and learned Assistant Government Pleader for respondents. 2.
Applicants seek condonation of delay in bringing on record of first appeal legal heirs of deceased respondent no. 2 in appeal and to amend title clause of appeal memo.

Learned Assistant Government Pleader has no particular objection for condonation of delay and grant the application. 4.
In view of aforesaid, having regard to that it would be conducive for further progress in the proceedings, civil application is granted. Delay condoned. Legal heirs of deceased respondent no. 2 in appeal i.e. present applicant no. 2 Kamanbai be shown on record of first appeal. Amendments accordingly be carried out by appellants in the memo of appeal and incidental applications made.

Application, as such, is granted in terms of prayer clauses (B) and (C) and is disposed of.
