The petitioner and its media personnel were granted accreditation as Press Reporter, for weekly 'Barasta Tuffan'. Their accreditation is valid until the end of this month. Admittedly, it is for the period of two years. It was submitted by the learned counsel for the petitioner that even they were present before the appellate authority, their absence has been marked and their prayer has been turned down only on the ground that petitioners' application for recommendation, did not bear the date. 2 905 wp 13409-24 ground was that there was no recommendation by the Divisional Level Committee.

Since as per the record petitioner and his other media personnel were shown to have not been present before the appellate authority and therefore, the appellate authority could not apply its mind i.e. they could not decide without giving proper opportunity of hearing to the petitioner. It would be in the fitness of things and in the interest of justice as well to set aside the order impugned herein with a direction to the appellate authority to consider the appeals on their on merits giving the petitioner and his other media personnel a full opportunity of hearing and even permission to amend the appeal memos, if they so desire. Until the appeals are decided on their own merit, there shall be interim relief in terms of prayer clause (C). Till decision of the appeals, the accreditation of the petitioner to continue.

We expect that the appellate authority would decide the appeal within a period of three months from the date of receipt of the copy of this order.
