The learned counsel appearing for the applicant tendered across the bar the order passed by this Court on 29.08.2018 in Civil Application No.9812 of 2018 in First Appeal No.1126 of 2018 arising out of the same acquisition proceedings and prayed for passing similar order in the present matter.

Shri Navandar, the learned counsel appearing for the respondent no.1 does not have any objection for passing such order. In view of the submissions so made, the following order is passed:

ORDER

i) The applicants are permitted to withdraw 50%

920-CA-14-2019 withdrawal .odt (2) of the deposited amount on submitting an undertaking to the satisfaction of the Registrar of this Court;

ii) Balance 50% amount be invested in Fixed Deposit Receipt in any Nationalized Bank, initially for one year and if so required for further period, till disposal of the appeal;

iii) Civil application for withdrawal of amount stands disposed of.

iv) Hearing of the appeal is expedited.
