After we had heard the learned Advocate for the Petitioner and the learned Advocate representing the Zilla Parishad in this Petition, we noticed in the light of the submissions of the learned Advocate for the Zilla Parishad Shri. Dheple that, the Petitioner has already preferred Writ Petition No.4680/2023 in this Court, wherein limited interim relief to the extent of protection of her services against termination and payment of salary, as was being paid earlier, was granted. This aspect was not brought to the notice of the learned Advocate for the Respondent, inasmuch as, the Petitioner has apparently

14586.23wp (2) suppressed this material information, for seeking further reliefs in this Petition. Such conduct of the Petitioner attracts the law laid down in Kishor Samrite Vs. State of Uttar Pradesh, (2013) 2 SCC 398, and Bhaskar Laxman Jadhav Vs. Karmaveer Kakasaheb Wagh Education Society, (2013) 11 SCC 531. 2.

The husband of the Petitioner is present in the Court. An apology is tendered and an amount of Rs.25,000/- is donated to the Advocates' Association of Bombay High Court, at Aurangabad. A receipt towards such payment is placed on record which is marked as 'X' for identification. With this, the Petitioner prays for leave to withdraw this Writ Petition. 3.

Considering the peculiar aspects as above, and the amount deposited with the Advocates' Association, Aurangabad, this Writ Petition is dismissed, as withdrawn on instructions. (Y. G. KHOBRAGADE, J.) (RAVINDRA V. GHUGE, J.) sjk
