ORDER :- 1.
Heard Mr. Rajendra Phatke, learned advocate for the applicant. He would submit that in view of the conditional order dated 23.11.2016, the writ petition suffered dismissal. He would submit that large number of writ petitions were placed on board and common conditional dated 23.11.2016 was passed. However, he could not notice that writ petition is listed on board by this court and could not comply the condition for removal of objection within a specified time. Mr. Phatke submits that it was inadvertent error on his part and petitioner shall not suffer for the same.

Notice of this application was issued to the respondents. In spite of service of notice, no reply is filed to this application. It appears that parties are litigating for right in respect of agricultural lands. In that view of the matter, civil application deserves to be allowed for the reasons stated in the application, subject to cost of Rs. 5,000/- to be paid to the Bar Association.

Civil application is allowed in terms of prayer clauses (B) and (C), subject to condition that the applicant deposits costs of Rs. 5000/- with the Bar Association within four weeks and also removes the office objections within two weeks.
