Applicants apprehend arrest in connection with Crime No. 875 of 2023 registered with Shevgaon Police Station, District Ahmednagar for offence punishable under sections 307, 326, 323, 143, 147, 148, 148, 504 and 452 of the Indian Penal Code.

Parmeshwar Sambhaji Lodhe lodged FIR stating that on 31.08.2023, at about 2.30 p.m., while he was collecting onions in front of his house, 15 accused persons armed with sickle, axe, iron rod and wooden logs etc. arrived there by forming unlawful assembly and assaulted informant and witnesses. Accused Babasaheb Lodhe assaulted with axe, Somnath with iron rod and Vishnu with sickle. All the accused abused informant and others in filthy language. 3.
Heard learned advocate for applicants and learned APP for respondent - State. Perused the papers of investigation.

Applicants in anticipatory bail application No.1852 of 2023 are women and applicants in anticipatory bail application No.1854 of 2023 are co-accused, against whom vague and general allegations are made. No specific allegations are made that they carried weapons or participated in actual assault. Charge-sheet is filed in the present crime on 21.12.2023. Accused Babasaheb, Somnath and Vishnu were arrested and released on regular bail.

Considering role attributed to applicants in the alleged offence, and as charge-sheet is filed, further custodial detention of applicants is not necessary.
