Mr.Jadhavar, learned counsel for the petitioner states that the petitioner was appointed as Assistant Teacher. He has successfully completed his probation period. Even approval was granted to the petitioner as Assistant Teacher but the Education Officer did not consider the proposal for continuation as Assistant Teacher on the ground that validity certificate is not produced. According to the learned counsel, the validation proceedings are pending with the Committee.

The learned A.G.P. states that within a period of eight (8)

months, the Committee would decide the validation proceedings. 4.

The leaned counsel for Respondent No.3 supports the order. 5.

It is for the Committee to decide the validation proceedings. The Respondent No.3 Education Officer can consider the proposal submitted by the Management for continuation of the petitioner on its own merits subject to the decision of the Committee in the validation proceedings.

In light of the above, the impugned order is quashed and set aside and the Education Officer shall reconsider the proposal in light of the observations made above.

The Writ Petition is disposed of. No costs.
